Prize A – A Green Home at Mahindra Vista Phase 1 in Kandivali, Mumbai (MahaRERA No. P51800054671).

The Winner of the Prize A shall be eligible for a residential apartment as per the allocation made by Mahindra Lifespaces at Mahindra Vista, a Green Home Project of Mahindra Lifespaces (“Prize A Apartment”) for NIL Sale Consideration in the Agreement for Sale upto a maximum amount of Rs 1 Crore. There shall be only one Winner for the Prize A Apartment.
In the event that the value of the Prize A Apartment is less than Rs 1 Crore, the Winner shall not claim refund or adjustment of the differential amounts. Further, in the event the value of the Prize A Apartment is more than Rs 1 Crore, the Winner shall be required to pay the differential amounts upon the written demand of Mahindra Lifespaces. Failing which the Prize A Apartment shall stand cancelled in favour of such Winner and Mahindra Lifespaces shall be entitled to allot the Prize A Apartment to the next eligible winner. The Winner cannot obtain a loan for the additional differential amount payable towards the Sale Consideration (if any) and needs to be paid from the Winner’s own sources.
The booking of the Prize A Apartment shall only be in the name of the Winner of the Prize A and shall be non-transferable.
Post announcement of the Winner and his confirmation and payment of any balance Sale Consideration, the Winner shall deposit the Tax Deducted at Source amount (“TDS Amount”) on the Sale Consideration of the Prize A Apartment as per Section 194B of Income Tax Act within 3 (three) months (or such other period specified by Mahindra Lifespaces) from the date of announcement of the Winner by Mahindra Lifespaces and completion of other formalities.
Upon the Winner making payment of the TDS Amount as mentioned hereinabove, the Winner shall register the Agreement for Sale with respect to the Prize A Apartment within 1 (one) month or such other period as specified by Mahindra Lifespaces. The Winner shall be liable to pay the Stamp Duty and Registration charges on the Agreement for Sale and the same is not included in the Prize A.
In the event the Winner defaults or delays in making payment of the TDS Amount and/or of the Stamp Duty and Registration charges as per the timelines mentioned herein, the allotment of the Prize A Apartment shall automatically stand cancelled and be withdrawn. In such an event, Mahindra Lifespaces shall be entitled to deal with the Prize A Apartment as it may deem fit, with no amounts to be paid and/or refunded to the Winner.
The Winner shall be liable to pay all expenses, maintenance charges, fees and charges, including all statutory levies, taxes, cess, etc. as per the Agreement for Sale pertaining to Prize A Apartment. Post clearance of all outstanding dues and on completion of the possession formalities as per the Agreement for Sale, the possession of the Prize A Apartment shall be handed over to the Winner.
The Winner shall not be entitled to raise any loan against the Prize A Apartment and/or create any encumbrances including mortgages, charge, lien thereon and/or sell, transfer, assign, gift, create any third-party rights thereon, until the possession of the Prize A Apartment is handed over to the Winner. The original copy of the Agreement for Sale of the Prize A Apartment shall remain in the custody of Mahindra Lifespaces, till the grant of possession of the Prize A Apartment is handed over by Mahindra Lifespaces to the Winner. In the event the Winner raises any loan and/or create any encumbrances on the Prize A Apartment, prior to the grant of possession by Mahindra Lifespaces, in such an event the allotment of the Prize A Apartment shall be automatically cancelled and be withdrawn. In such an event, Mahindra Lifespaces shall be entitled to deal with the Prize A Apartment as it may deem fit, with no refund to the Winner. Further, Mahindra Lifespaces shall not make any further payment of any amounts and/or compensation and/or prize to the Winner.
The employees of Mahindra Lifespaces and its affiliates, subsidiaries, assignees, representatives and their family members are not eligible to participate in the lucky draw for Prize A Apartment.
Mahindra Lifespaces will not be responsible for reimbursement and/ or payment of the Income Tax Liability (if any) arising on the Winner under Section 56(2)(X) of Income Tax Act (Tax on Income by way of winnings from lotteries, crossword puzzles, races including horse races, card games, gambling or betting of any form or nature whatsoever) or any other provision under the Income Tax Act 1961, which shall be payable by the Winner.
